In the first round, the learned counsel for the appellant submitted that the matter may be heard on urgency, as the property is being proceeded for recovery of the dues.
Learned counsel for the respondent-Bank submitted that the property is already mortgaged with the Bank and for mortgage property, no attachment is required and the matter is fixed for hearing on 01.04.2022.
Learned counsel for the appellant argued that there is a judgment of the Hon’ble Apex Court, which is not available at this time, so the matter may be taken up in the second round.
When the matter was called out in the second round, Shri Rai was not present, therefore, the matter be listed on the date already fixed for hearing on 01.04.2022.
