Regular Appeal No. 172/2018 Date: 25.11.2022
Yashwant Singh & Ors. Vs. UCO Bank
Present: Shri Anil Bhushan, Senior Advocate assisted by Shri Alok Rai, counsel for the appellants, Shri P. K. Gupta, counsel for the respondent-Bank,
Learned counsel for the respondent-Bank files his written submission.
Learned counsel for the appellants states that as per record of the Bank, entire dues against the appellants was Rs. 45.00 lacs, but the O.A. has been filed by the respondent-Bank for recovery of Rs. 63,65,147/-. It is further contended that the amount of Rs. 14.00 lacs has been deposited in interregnum, which has not been accounted in the O.A., which has been filed for recovery of amount due against the appellants.
Learned counsel for the respondent-bank states that the amount, which was claimed, was the principal amount due along with interest after the account was declared as NPA. He further contended that the receipt of deposit of Rs. 14.00 lacs, as is alleged to have been paid by the appellants, may be brought on record to show the amount has been deposited.
