Learned counsel for the appellants submits that the appellant is senior citizen and two loans were granted by the Bank, one for Rs. 45.00 lacs and another for Rs. 13.00 lacs, out of which total amount repaid is more than Rs. 80.00 lacs excluding pre-deposit made in this Tribunal. It is further contended that the order impugned has been obtained by concealing the facts and playing fraud. It is also contended that the auction sale is likely to be taken, therefore, interim protection may be granted during the pendency of the present appeal.
List this case on 10.04.2023. Till the next date of listing, the status quo qua the property in question, as it exists today, shall be maintained by all the parties concerned.
Learned counsel for the appellant has filed an application, after serving copy of the same to the counsel for the bank, who may file reply by the next date.
