Learned counsel for the appellant submits that the order impugned has been obtained by concealment of the fact and playing fraud, therefore, the same is not sustainable in the eye of law.
Learned counsel for the respondent-Bank submits that no question of fraud was raised by the appellant before the Tribunal below and new ground cannot be taken in the present appeal.
