Present: Shri Sudhanshu Mishra, counsel for the appellants, Shri K. K. Tiwari, counsel for the respondent-Bank, None for the other respondents,
Learned counsel for the appellants files a copy of the newspaper, in which notice was published for the respondent no. 3, who is son of deceased respondent no. 2. However, Shri Utkarsh Malviya, Advocate has already put in his appearance and filed vakalatnama on behalf of the respondent no. 3.
The record shows that the notices were sent earlier to the said respondents No. 4 to 6, but the same have returned back unserved with remark ‘left’. Therefore, the appellant is directed to take steps for service upon the said respondents through paper publication in the newspapers having wide circulation in the area. Affidavit of service be filed by next date.
The office report dated 09.03.2022 reveals that reply of the Bank is on record, but no rejoinder has been filed till date. Let the same be filed by the next date.
