Heard the learned counsels for the parties.
Since the matter is already fixed today, therefore the urgency application being I.A. No. 335/2024 has become infructuous and is disposed off as such.
Learned counsel for the appellants contends that against the order dated 29.11.2023 passed by the Recovery Officer, the Appeal Dy. No. 1224/2023 is pending and the next date in the said case is fixed for 29.04.2024. It is further contended that the Bank accounts of the appellants have been seized and the appellant no. 1 is suffering from fracture in his ankle bone and he needs funds for his medical treatment. Learned counsel further submits that the Tribunal below may be directed to decide the application for grant of interim order on the next date fixed.
In view of the above, the present appeal is finally disposed off with direction upon the Tribunal below to consider and decide the Appeal Dy. No. 1224/2023, which is listed on 29.04.2024 and if not possible to decide the appeal on the date fixed, then interim application filed by the appellant may be considered and appropriate order may be passed on that date in accordance with law.
