Present: Shri Rakesh Mishra, counsel for the appellant, Shri Himanshu Tiwari, counsel for the respondent-Bank,
Heard the learned counsels for the parties.
Learned counsel for the appellant contends that the present appeal has been filed against the possession notice and no auction sale has been challenged, therefore, the condition of pre-deposit is not applicable in the present appeal.
Learned counsel for the respondent-Bank contends that the possession has already been taken and the S.A. is still pending before the Tribunal below.
In view of the above, the present appeal is finally disposed off with the direction to the Tribunal below to consider and decide the said S.A. most expeditiously in accordance with law preferably within three months from the date of production of certified copy of this order.
