Police on receiving secret information about carrying theft generator searched the pick-up van and recovered one generator set, in that course, petitioners and others are said to be fled away from the pick-up van but on chase, they were apprehended.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that petitioner was not arrested on the pick-up van but he was apprehended in fleeing condition nearby pick-up van. It is also submitted that similarly situated co-accused Rakesh Kumar Roy,

who are said to be apprehended with this petitioner, has already been allowed bail by a Bench of this Court vide Cr. Misc. No.47141 of 2013 on 25.11.2013 and this petitioner is in custody since 14.08.2013.

Under the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of F.T.C. No. IIIrd, Darbhanga in connection with Sessions Trial No. 460 of 2013. Out of two sureties, one surety must be parent or close relative of the petitioner.
