The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 418 and 420 of the Indian Penal Code. The accusation is of misappropriating money to the tune of Rs. 1,82,000/- of the beneficiaries under Indira Awas Scheme. It is submitted by learned counsel for the petitioner that the petitioner was neither the panchayat representative nor any officer in administration and maliciously accusation has been levelled against the petitioner when accusation was found false and final form was submitted but differing with the same cognizance was taken in 2000. registered in 1998, this Court is not inclined to
interfere. However, since the accusation was found
false during investigation, the aforesaid facts
constitute good grounds for consideration of regular
bail of the petitioner if he surrenders within a
period of six weeks from the date of receipt of copy
of this order in connection with Narpatganj P.S.
Case No. 177 of 1998, G. R. No. 1487 of 1998 pending
in the court of the learned S.D.J.M., Araria.
With this observation, the application is
disposed off.
