JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 08-04-2013 Heard learned counsels for the petitioners and the State. The petitioners being brothers and nephew of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The accusation is of killing the sister of the informant after 18 years of marriage. Specific allegation is of making assault. When the postmortem report reflects abrasions, swelling and bruises though the cause of death has been found to be due to asphyxia due to throttling.

It is submitted that the informant is not an eye witness of the occurrence and the accusation is general and omnibus when the husband of the victim has not been made accused.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Dehri in connection with Rohtas P.S. Case No. 46 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
