04/	09-07-2013 Heard learned counsels for the petitioners, the State
	and the informant.
	The petitioners are languishing in custody since 05.01.2013 and 23.12.2012 in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

It is alleged that it was agreed to transfer the land in favour of the informant when Rs,3,75,000/- was paid to petitioner Kanhaiya Singh who handed over the same to petitioner Gauri Shankar Singh but neither the sale deed was executed nor the money was returned. The giving of money is not in dispute.

The petitioners undertake to deposit the said amount within a period of six months before the learned court below.

Considering the undertaking of the petitioners, let the above named petitioners, be released on bail provisionally for six months on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Buxar (T) P.S. Case No. 356 of 2012.

The provisional bail of the petitioners will be confirmed by the learned court below on deposit of the aforesaid amount. The said money will be released in favour of the informant if the informant files proper application for withdrawal/compromise of the case, otherwise it will be invested in some fixed deposit scheme by the learned court below.
