JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 08-07-2013 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 13.07.2012 in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
The married daughter of the informant went out on 22.08.2011 when the suspicion was raised against the petitioner and others after recovery of her dead body.
It is submitted by learned counsel for the petitioner that there is no eye witness to the occurrence when the victim was married daughter of the informant and used to reside at her parents’ house and had illicit relationship with Anuj Paswan when it is alleged that Anuj Paswan with the help of the others committed the murder of the daughter of the informant. Supplementary affidavit has been filed that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Belaganj P.S. Case No. 190 of 2011.
