The petitioner is languishing in custody since 21.12.2012 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 386, 379 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that on the order of Shambhu Singh, Kakku Singh fired at the brother of the informant but no injury was caused when Kallu Singh and this petitioner assaulted the brother of the informant with Bhujali and subsequently Deo Singh and Kakku Singh resorted to firing.

It is submitted by learned counsel for the petitioner that the medical examination of the brother of the informant was done in a private nursing home and a statement has been made in para 8 that the petitioner has no criminal antecedent. The petitioner is accused in one other case apart from the present

case and same was lodged at the behest of the informant.

Considering the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Patna City in connection with Agamkuan P.S. Case No. 317 of 2012.
