The petitioner is accused in Sabour P.S. Case No.83 of 2013 registered under Sections 147, 148, 149, 341, 323, 325, 307, 379, 353, 504, 506, 427, 283, 336, 337, 338, 448 and 447 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner and 29 others F.I.R. named accused are daily wages employees of the Agriculture University, Sabour, District-Bhagalpur and at the time of the alleged occurrence, they were sitting on Dharna for their demand of regularization of their services. In the meantime, police party reached there and tried to disburse them. In that course, there were hot exchange of words in between them but no assault was made by the petitioner and others but they have been falsely implicated in the present case. It

is also submitted that while the petitioner is named in the F.I.R. but no specific overt act has been alleged against him. Petitioner is in custody since 8.7.2013.

The allegation against the petitioner and 29 others F.I.R. named accused and 300 other miscreants is that they armed with weapon surrounded the residence of the Vice Chancellor of the Agriculture University, Sabour, District-Bhagalpur and when on receiving the said information, the police party reached there, the mob including the petitioner started to assault them in which several police personnel sustained injuries. There is also allegation against them that they damaged the Police Jeep and took away the files kept in the Police Jeep.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Sabour P.S. Case No.83 of 2013.
