The petitioners are accused in Pauthu P.S. Case No.12 of 2013 registered under Sections 147, 148, 149, 341, 342, 323, 325, 324, 307, 447, 448 and 379 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that the petitioners are gotiyas of the informant, Kiran Devi, and due to land dispute, petitioners have been made accused in this case. It is also submitted that while the allegation against the petitioners and 11 others is to cause injury to the informant, Kiran Devi, her daughter, Madhuri Kumari, and father-in-law, Rajnandan Sharma, but the injuries found on their persons were simple in nature except one injury which was in the teeth of Madhuri Kumari, the daughter of the informant, Kiran Devi. petitioners are in jail custody since 27.6.2013.

The allegation against the petitioners and 11 others is to cause injury to the informant, Kiran Devi, her daughter, Madhuri Kumari, and father-in-law, Rajnandan Sharma, through lathi and danda. There is also allegation of taking away the bag containing cash of Rs.1,00,000/- from the box against the accused persons including the petitioners. The petitioners and the informant are co-villagers.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Pauthu P.S. Case No.12 of 2013.
