The petitioners seek bail in connection with Sessions Trial No. 586 of 2008 arising out of Sahar P.S. Case No. 147 of 1995 registered for the offence punishable under Sections 147, 148, 341, 323, 324 and 307 of the Indian Penal Code.

Learned counsel for the petitioners submits that this is a case of misuse the privilege of bail by the petitioners. It is further submitted that under the impression that the next date is 26.06.2013 whereas the next date was fixed for 22.06.2013, the petitioners could not remain present on 22.06.2013 and, therefore, the cross-examination of P.W.3, namely, Chandeshwar

Choudhary, could not be done and bail bonds of the petitioners were cancelled and petitioners surrendered before the court and were taken in custody on 22.07.2013 and since then the petitioners

Having regard to the facts and circumstances of the case, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 5^th F.T.C., Bhojpur at Arra, in connection with Sessions Trial No. 586 of 2008 arising out of Sahar P.S. Case No. 147 of 1995.
