The present appeal has been filed under Section 14(A) of the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act.

This criminal appeal has been filed against the order dated 03.02.2022 passed by the learned Addl. Sessions Judge-I, Garhwa in A.B.P. No.73 of 2022 in connection with SC/ST P.S. Case No.11 of 2019, registered for the offence under Sections 323/ 324/ 325/ 341/ 307/ 506 and 34 of the Indian Penal Code and Section 3/4 of the SC/ST Act by which prayer for anticipatory bail of the appellants have been rejected.

It appears that the dispute has taken place between the parties over parking of vehicle. Entire family members including old aged persons and females have been made accused in the present case. The only male accused has withdrawn the appeal and subsequently surrendered in the court below. Now the appellants are lady member and one is the old aged person.

It has been submitted by learned counsel for the appellants that no offence is made out rather it is the misuse of the protective act of SC/ST. They are neighbours and it is neighbourhood dispute. On above facts prayer for bail has been made.

Learned counsel for the State and learned counsel for the victim has opposed the prayer for bail.

Considering the peculiar fact of the case and the fact that the appellant are lady members and old age person, appellants, named above are directed to surrender in the court below, within four weeks from the date of receipt/production of this order, and in the event of their arrest or surrender, the court below shall enlarge them on bail, on his furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of like amount each to the satisfaction of the learned Addl. Sessions Judge-I, Garhwa in

connection with SC/ST P.S. Case No.11 of 2019, on the conditions as laid down under Section 438 (2) Cr.P.C.

Accordingly, the instant appeal is, hereby, allowed.
