1. Heard learned counsel for the applicant and learned counsel for the State.

2. The applicant who is in custody since 11.09.2021 has approached this Court for grant of regular bail in connection with T. Tangar P.S. Case No.43 of 2021, registered for the offence under Sections 379 of the Indian Penal Code and subsequently 411 IPC has been added.

3. It appears that the applicant is accused of committing theft of Solar Plate and bulbs.

4. Innocence has been claimed by the learned counsel for the applicant and it has been submitted that the applicant undertakes to participate in the trial. Further, six criminal antecedent has been reported out of which in three cases he has already been acquitted. In one case he has been convicted and two cases is pending. On the above basis, the prayer for bail has been made.

5. Counsel for the State has opposed the prayer for bail.

Considering the period of custody, the applicant, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-Ist Class, Simdega in connection with T. Tangar P.S. Case No.43 of 2021, subject to condition that one of the bailors must be the close relative of the applicant and the sureties will be the ancestral property of the applicant. Further, the applicant will submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
