The applicant, who is in custody since 29.09.2021, has approached this Court for grant of regular bail in connection with S.T. No.55 of 2022 arising out of Jaldega P.S. Case No.21 of 2020 {G.R. No.253 of 2020(s)} registered for the offence under Sections 147, 148, 149, 353 and 307 the Indian Penal Code, Section 25 (1-A), 26 (2), 27 and 35 of the Arms Act and Section 17 (i) (ii) of the C.L.A. Act.

The applicant is an accused of Arms Act and no recovery has been made from his conscious possession.

It has been submitted that the applicant is a farmer and depend upon the ancestral landed property. Investigation is complete and the applicant undertakes to participate in the trial. Although there are two criminal antecedents against the applicant but in one of the cases, he has already been enlarged on bail. On the above facts, prayer for bail has been made.

On the other hand, learned A.P.P. has opposed the prayer for bail.

Considering the fact that the investigation is complete and no recovery has been made from the possession of the applicant, I am inclined to enlarge the applicant on bail. Accordingly, the applicant, above named, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Simdega, in connection with S.T. No.55 of 2022 (one of the sureties should be the landed ancestral property) , on the condition that the applicant will submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
