Petitioners are accused in connection with Arki P.S. Case No. 37 of 2018.

It has been alleged that when the informant along with his wife returned from Sohrai festival he could not find his sister. In the next morning also his daughter could not be traced out. It has been alleged that about 10 months ago the father of petitioner No. 1 and Satura Saransi had died and it was suspected that the sister of the informant was responsible as she practices witchcraft. The petitioners were suspected to have kidnapped her. It appears that subsequently dead body of the sister of the informant was recovered.

It has been stated by the learned counsel for the petitioners that save and except self confession of petitioner No. 2, there is no other material on record.

Learned APP for the State on the other hand has referred to certain paragraphs of the case diary specially Para 25 of the case diary in which on the basis of confession made by Satura Saransi, Ramdeo Lohra @ Buchu Nath and Mangal Munda the dead body of the sister of the informant was recovered. It therefore appears that save and except suspicion there is no other evidence available on record to indicate the complicity of the petitioner in the commission of the offence.

Regard being had to the above, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khunti in connection with Arki P.S. Case No. 37 of 2018.
