6/07.11.2019 Heard Mr. Rohit Agrawal, learned counsel appearing for the petitioner and Mr. Shiv Shankar Kumar, learned A.P.P. for the State.
The petitioner is an accused in connection with Kadma P.S. Case No. 40 of 2019 corresponding to G. R. No. 535 of 2019.
It has been alleged that there was a land dispute between the husband of the informant and accused persons. It has further been alleged that on 14.02.2019, the husband of the informant had gone out for work but did not return. A missing report was lodged on 15.02.2019 and later on she came to know that a quarrel had taken place between her husband and others. One Aakash Bhagat had disclosed that the accused persons had committed the murder of her husband. It appears that one of the co-accused namely, Shakti Singh on whose instance the dead body of the deceased was recovered has been granted bail by this Court in B. A. No. 9129 of 2019. Some of the other co-accused persons namely, Puspa Devi and Prashant Sagar Singh have also been granted bail by this Court in B. A. No. 5905 of 2019. It appears that it was one Aakash Bhagat who had disclosed about the accused persons and the said Aakash Bhagat has been subsequently arrayed as an accused.
In view of the aforesaid, it appears that there is no direct allegation which would show the complicity of the petitioner and accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge V, Jamshedpur in connection with S. T. No. 285 of 2019 arising out of Kadma P. S. Case No. 40 of 2019 corresponding to G. R. No. 535 of 2019.
