The petitioner is an accused in connection with S.T. No. 78/2018, arising out of Kathikund P.S. Case No. 55/2013, corresponding to G.R. No. 991/2013.

It has been alleged that on getting information that firing was going on the informant-party reached the place of occurrence where one constable was found dead inside the vehicle. The body of the Superintendent of Police, Pakur was seen lying in a ditch. One of the injured persons had disclosed that indiscriminate firing was made by the extremists which resulted in the incident. The petitioner appears to be not named in the First Information Report.

Md. Azeemuddin, learned A.P.P. for the State while going through the case diary has stated that the petitioner's name has come on the confessional statement of co-accused Sanatan Baskey which has been reflected in para 326 of the case diary. He further submits that in the supplementary case diary at para 36 the self confession of the petitioner has been recorded. He has also submitted that the petitioner has got six criminal antecedent.

At this, Mr. Vishal Kumar Trivedi, learned counsel for the petitioner submits that apart from the present case the petitioner is involved in five other cases and in all the cases he is on bail.

It appears from the supplementary affidavit that out of 45 witnesses 15 witnesses have been examined till date. The

evidence so far as the involvement of the petitioner in the commission of the offence appears to be on the basis of the confession of Sanatan Baskey apart from the self confession of the petitioner. It further appears that there is no chance of the trial being concluded in the near future in view of the fact that almost 30 witnesses are still left to be examined.

On consideration of the aforesaid facts, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Dumka in connection with S.T. No. 78/2018, arising out of Kathikund P.S. Case No. 55/2013, corresponding to G.R. No. 991/2013, subject to the condition that he shall remain physically present before the learned trial court on each and every date till the conclusion of the trial and one of the bailors should be a close relative of the petitioner.
