Heard Mr. Faizur Rahman learned counsel appearing for the petitioner and Mr. Suraj Verma learned APP appearing for the State assisted by Mr. Ashish Verma, learned counsel for the opposite party No. 2.
Petitioner is an accused in connection with Sukhdeo Nagar P.S. Case No. 454 of 2018.
It has been alleged that the daughter of the informant went out but did not return. Suspicion has been cast against the petitioner of enticing away the daughter of the informant.
It appears that the marriage of the petitioner and Jyoti Kumari has been solemnized for which reference has been made to the marriage certificate. It has been stated that the statement of said Jyoti Kumari recorded u/s 164 Cr.P.C. has also substantiated the factum of marriage.
During the pendency of this bail application, the petitioner was granted provisional bail but since the petitioner was in jail in connection with another case he was not released. The petitioner is in custody since 19.01.2019.
Regard being had to the statement of the victim recorded u/s 164 Cr.P.C., the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ranchi in connection with Sukhdeo Nagar P.S. Case No. 454 of 2018.
