Heard the learned counsel for the parties.

The petitioner is an accused for the offence under Sections 498A, 323, 324, 341, 420, 494, 504 of the Indian Penal Code and Sections 3/ 4 of the Dowry Prohibition Act.

It is alleged that the petitioner being the husband has tortured the informant and has driven out from her matrimonial home and thereafter, the petitioner has solemnized the second marriage.

Counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he is in custody since 6.9.2017 and he is merely a labourer.

Upon instruction from his client, he further submits that the petitioner is ready to pay Rs.1,500/- per month to the informant as allowance.

Learned counsel for the informant as well as learned A.P.P opposes the prayer for bail and submits that the petitioner has solemnized second marriage.

Taking into consideration the period of custody of the petitioner and the submission so made, I am inclined to release him on bail. Accordingly, the petitioner, namely, Kishore Kumar Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1^st Class, Ramgarh, in connection with Patratu (Barkakana) P.S. Case No. 148/2017, corresponding to G.R. No. 588 of 2017, subject to condition that he will pay a sum of Rs.1,500/- (one thousand five hundred) per month by 10^th of the succeeding month and will furnish proof of such payment before the court below, failing which necessary steps will be taken by the court for his re-arrest.
