The petitioner is an accused for the offences punishable under section 364,34,120B of the Indian Penal Code and later on section 302 of the Indian Penal Code has been added vide order dated 5.7.2017.
It is stated that on phone call the son of the informant left his house and thereafter son of the informant confirmed that it is this petitioner who had called him, but after some time he has become traceless. It is alleged that the petitioner has committed murder of the deceased along with his associates.
Learned Sr. counsel for the petitioner submits that save and except confessional statement, there is nothing against the petitioner.
Addl. P.P. opposes the prayer for bail and submits that the wife of the petitioner had some illicit relation with the son of the informant as a result of which this occurrence has taken place. He, after going through the case diary, submits that there is no other material against the petitioner save and except the confessional statement.
Taking into consideration the aforesaid facts and the submissions made by the learned counsel for the parties, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Mithilesh Kumar Yadav is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Palamau at Daltonganj, in connection with S.T. No. 412 of 2017, arising out of Sadar (Satbarwa O.P.) P.S. Case No. 89 of 2017, corresponding to G.R. No. 1329 of 2017.
