Heard the learned counsel for the parties.
The petitioner is an accused for the offence under Sections 302/34 of the Indian Penal Code.
Counsel for the petitioner submits that the petitioner has been made accused in this case only on the basis of suspicion.
The FIR is against unknown and admittedly, it is apparent that no one has seen the petitioner committing the murder of the deceased.
Learned A.P.P opposes the prayer for bail of the petitioner but he does not controvert the fact that the petitioner has been made accused in this case only on the basis of suspicion.
In view of the aforesaid facts, the petitioner, namely, Rajan Rajak @ Chhotu @ Chhotu Ram is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Palamau at Daltonganj, in connection with Sadar (Satbarwa OP) Case No. 135/2017, corresponding to G.R. No. 2172 of 2017.
