Laxman Gope Alias Koya And Anr. Vs The State Of Jharkhand

The petitioners have been made accused in connection with Kolebira P.S. Case No.39 of 2015, corresponding to G.R. No.310 of 2015, for the offence under Sections 414, 386, 387, 212, 216 of the Indian Penal Code, Sections 25(1-B)(a)/ 26/ 35 of the Arms Act and Section 17 of the C.L.A. Act.

The petitioners were apprehended on 11.7.2015 and from the possession of the petitioners, country made rifles and several cartridges were recovered. The petitioners were found to be belonging to the extremists group.

In the facts of this case, taking into consideration the period of custody of the petitioners, I am inclined to release the petitioners on bail. Accordingly, the petitioners, Laxman Gope @ Koya & Kaleshwar Gope, are directed to be released on bail, on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Vikram Anand, learned Judicial Magistrate, Simdega, or his successor, in connection with, Kolebira P.S. Case No.39 of 2015, corresponding to G.R. No.310 of 2015.
