5/8.03.2016 Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner has been made accused for the offence under Sections 366-A, 506 / 34 of the Indian Penal Code, in connection with Hariharpur P.S. Case No.66 of 2015, corresponding to G.R. No.5121 of 2015.
There is direct allegation against the petitioner to have kidnapped the minor daughter of the informant.
The statement of the victim girl has been recorded under Section 164 of the CrPC, wherein she has disclosed her age to be 14 years and the Court below has also assessed her age about 14 years. She has fully supported the case of kidnapping her against the petitioner.
In the facts and circumstances of the case, I am not inclined to release the petitioner on bail. Accordingly, prayer for bail stands rejected.
