05/ 08.03.2016 Both these bail applications arise out of the same case and as such, they are taken up together and disposed of by this common order.

The petitioners have been made accused for the offence under Sections 394, 395 and 412 of the Indian Penal Code, in connection with Sahibganj (T) P.S. Case No. 259 of 2015 corresponding to G.R. No. 683 of 2015. The case relates to dacoity and the case was instituted against

unknown.

Learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in this case submitting that the other similarly situated co-accused, namely Nepal Kumar Sinha has been granted bail by order dated 18.12.2015 in B.A. No. 9855 of 2015. Learned counsel has accordingly, prayed for bail.

Learned counsel for the State has opposed the prayer for bail submitting that the confessional statements of these petitioners have led to the recovery of looted ornaments from the house of other co-accused persons. However, it is admitted that the case of these petitioners is similarly situated to co-accused Nepal Kumar Sinha.

In the facts of this case, I am inclined to enlarge the petitioners, Vikash Mandal and Vikash Murmu @ Jharkhandi @ Jharkhandi Vikash Kumar Murmu, on bail. Accordingly, the petitioners, named above, are directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Sahibganj, in connection with Sahibganj (T) P.S. Case No. 259 of 2015 corresponding to G.R. No. 683 of 2015.
