13/03.07.2014 An urgency slip was filed by the counsel for the applicant and therefore, the matter has been listed today.

Heard the learned counsel appearing for the parties and perused the documents on record.

The learned counsel appearing for the applicant submits that the applicant is apprehending his arrest in connection with Deoghar Nagar P.S. Case No. 273 of 2013 corresponding to G.R. No. 866 of 2013 registered under Section 27(b)(ii) of the Drugs and Cosmetics Acts, 1940.

The learned counsel appearing for the applicant submits that when the tender was floated it was not the condition that the medicine should have been kept in the cold-storage however, when an order for supplying Oxytocin injection was awarded to the applicant, the applicant applied for grant of licence and it was duly granted to him on 15.03.2013.

The learned A.P.P. appearing for the State opposes the prayer for grant of anticipatory bail and submits that at the time of floating the tender, the applicant was possessing valid licence for cold-storage.

Pursuant to order passed by this Court, a counter-affidavit dated 02.07.2014 has been filed stating that on verification, the licence produced by the applicant has been found to be genuine. It appears that vide order dated 12.02.2014, interim protection was granted to the applicant and there is no report of any misuse by the applicant.

In the facts and circumstances of the case, in the event of arrest of the applicant namely, Nandlal Prasad or if he surrenders before the trial court within a period of four weeks from today, he would be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Deoghar in connection with Deoghar Nagar P.S. Case No. 273 of 2013 corresponding to G.R. No. 866 of 2013.
