02/02.07.2014 Heard the learned counsel appearing for the parties and perused the documents on record.

The learned counsel appearing for the applicant submits that the applicant is apprehending his arrest in U.C. Case No. 217 of 2012, instituted under Sections 33, 41, 42 of the Indian Forest Act and under Section 2/3 of the Forest Conservation Act, 1980.

The learned counsel for the applicant submits that, the applicant is the owner of the tractor which was allegedly carrying stone chips/boulder. In the prosecution report the name of the applicant has though been mentioned, it is admitted that the applicant was not present at the place of alleged occurrence nor he was seen by the forester. It is further submitted that the report has been submitted for the offence under Sections 33, 41, 42 of the Indian Forest Act and under Section 2/3 of the Forest Conservation Act, 1980 and maximum sentence for the offence as alleged is six months only.

The learned A.P.P. appears and opposes the prayer for grant of anticipatory bail and submits that the applicant being the owner of the tractor is also liable for prosecution.

In the facts and circumstances of the case, in the event of arrest of the applicant or if the applicant surrenders before the trial court within a period of four weeks from today, the applicant namely, Pradeep Kumar Singh @ Praveen Kumar Singh would be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Md. Taufique Ahmad, learned Judicial Magistrate, Ist Class, Chatra or his successor in U.C. Case No. 217 of 2012.

Let a copy of this order be sent through 'FAX' to the concerned Trial Court on depositing the cost by the applicant.
