04/03.07.2014 Heard the learned counsel appearing for the parties and perused the documents on record.
The learned counsel appearing for the applicant submits that the applicant has been made an accused in connection with Simdega P.S. Case No. 88 of 1995 corresponding to G.R. No. 314 of 1995 (T. R. No. 55 of 2009) registered under Sections 419/420/467/468/470/471/120B of the Indian Penal Code.
The learned counsel appearing for the applicant submits that initially a First Information Report was lodged on 16.10.1995 in which the applicant was named as accused. The matter was investigated by the C.I.D and the complicity of the applicant was not found in the alleged occurrence and therefore, he was not sent up for trial. He further submits that two accused persons who faced the trial, were convicted by the learned trial court however, in the appeal filed by those accused persons, the Appellate Court directed for retrial and that is how the present case has been initiated against the applicant. It is submitted that the applicant is in judicial custody since 29.03.2014. The learned A.P.P. opposes the prayer for grant of bail.
In the facts and circumstances of the case, the present applicant namely, Nageshwar Prasad Yadav is directed
to be released on bail on furnishing bail bond of Rs. 10,000/(Ten Thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Simdega, in connection with Simdega P.S. Case No. 88 of 1995 corresponding to G.R. No. 314 of 1995 (T. R. No. 55 of 2009).
