02/03.07.2014 Heard the learned counsel appearing for the parties and perused the documents on record.
The learned counsel appearing for the applicant submits that the applicant has been made an accused in connection with S.T. No. 370 of 2013 arising out of Raidih P.S. Case No. 55 of 2012 (G.R. No. 917 of 2012) registered under Sections 147/148/149/341/342/323/302/307 of the Indian Penal Code.
The learned counsel appearing for the applicant submits that from a bare perusal of the First Information Report, it would appear that the informant is not an eye witness to the occurrence. The applicant was found standing at the place of occurrence. Other co-accused namely, Santosh Xaxa, Rajendra Gope, Sudan Gope@ Sudhan Gope and Nige Gope who are also named in the First Information Report have already been granted bail by this court vide order dated 10.04.2014 in B.A. No. 2237 of 2014 and order dated 22.04.2014 in B.A. No. 1923 of 2014. The applicant is in judicial custody since 03.09.2013.
The learned A.P.P. opposes the prayer for grant of bail and submits that the trial has already commenced.
In the facts and circumstances of the case, the applicant namely, Netlal Gope is directed to be enlarged on bail on furnishing bail
bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Principal Sessions Judge, Gumla in connection with S.T. No. 370 of 2013 arising out of Raidih P.S. Case No. 55 of 2012 (G.R. No. 917 of 2012).
