04/02.07.2014 Heard the learned counsel appearing for the parties and perused the documents on record.

The learned counsel appearing for the applicant submits that the applicant is apprehending his arrest in connection with Dhanbad P.S. Case no. 1141 of 2013 corresponding to G.R. Case No. 4903 of 2013 registered under Sections 467, 468,471,420 and 120(B) of the Indian Penal Code, under Section 82 of the Indian Registration Act and under Section 46(b) of the Chota Napgur Tenancy Act.

The learned counsel for the applicant submits that the applicant who is a practicing advocate, on the instruction of his client Subhash Rai, prepared a sale deed. Subsequently it was reported to the office of the registering authority that the caste of said Subhash Rai was wrongly mentioned in the sale-deed and on that basis the applicant has also been added as an accused in First Information Report being Dhanbad Sadar P.S. Case No. 1141 of 2013 dated 04.12.2013. The learned counsel appearing for the applicant submits that the applicant prepared the sale deed on the instruction of his client and his client finding the same true and correct signed it and therefore, the applicant cannot be held responsible for any false averment made in the sale deed.

The learned A.P.P. opposes the prayer for grant of anticipatory bail and submits that on the basis of the show-cause reply dated 01.11.2013 submitted by the said Subhash Rai to the Deputy Commissioner, Dhanbad the present criminal proceeding was initiated.

In the facts and circumstances of the case, in the event of arrest of the applicant namely, K.P. Gorain @ Kali Pado Gorain @ Kali Pada Gorain or if he surrender before the trial court within a period of four weeks from today, he would be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Dhanbad in connection with Dhanbad P.S. Case No. 1141 of 2013 corresponding to G.R. Case No. 4903 of 2013.
