Heard the learned counsels for the parties on the urgency application being I.A. No. 372/2023.
Learned counsel for the appellant states that Rs. 30.80 lacs has already been deposited by the appellant and he is ready to argue the matter, but needs some time to prepare the matter. Learned counsel also states that on the next date, he will argue the matter and no further adjournment will be sought for. Learned counsel also prays that the interim order, which was granted earlier, may be extended till the next date.
Learned counsel for the respondent-Bank vehemently opposes the contention raised by the learned counsel for the appellant and states that the appellant has deliberately avoided the hearing of the present appeal.
List this case on the date already fixed i.e. 01.08.2023. On the next date, the matter will not be adjourned, by that time, the learned counsels for the parties may file written submissions, if so desired. Till the next date, the interim protection, which was granted earlier, shall remain operative. The urgency application is disposed off as such.
