Heard the learned counsel for the appellant on the urgency application being I.A. No. 691/2022.
It is contended that the personal property of the appellant has been attached by the Recovery Officer, which is going to be sold on 10.01.2023.
Any proceeding of the sale by the Recovery Officer is challengeable before the Presiding Officer, DRT and if any such action is taken, the same may be challenged there.
The report of the Registrar dated 14.12.2022 shows that the next date fixed in this case is 07.02.2023. There is no good ground made out for preponing the date, which is fixed for 07.02.2023. Accordingly, the urgency application is rejected.
List this case on the date already fixed i.e. 07.02.2023.
