Heard the learned counsel for the appellant.
An urgency application being I.A. No. 213/2022 and stay application being I.A. No. 214/2022 have been filed with a prayer to expedite the hearing of the present case and further to restrain the respondent-Bank from auctioning the property in pursuance of proclamation of sale in DRC No. 828/2019.
The record shows that the present appeal is filed against the order dated 07.12.2009 passed by the DRT, Allahabad in O.A. No. 257/2016 and the next date fixed in the case is 03.08.2022 for hearing.
After hearing the learned counsel for the appellant, both the aforesaid applications are disposed off with liberty to the appellant to file appropriate application with regard to restraining the defendant-Bank from auctioning the property pursuant to the sale proclamation in DRC No. 828/2019 before the DRT concerned, if so desired. If such application is moved before the Tribunal below, may consider and decide the same most expeditiously in accordance with law.
There is no ground made out for expediting the hearing of the present appeal, therefore, list the case on the date already fixed i.e. 03.08.2022.
