ORDER: (per the Hon’ble Sri Justice N.V.Ramana)

This Public Interest Litigation is filed seeking a direction to respondents 1 and 2 to implement G.O.Rt.No.187 (Health, Medical & Family Welfare (A1) Department), dated 31-01-2013 and consequently to direct the 1^st respondent to relieve the erring doctors Sri Dr.P.Hari Krishna, Professor of Forensic Medicine, Osmania Medical College & Hospital, Hyderabad-3^rd respondent and Dr.R.Sudha, Assistant Professor of Forensic Medicine, Osmania Medical College, Hyderabad-4^th respondent in the public interest.

The main grievance of the petitioner is that on several complaints being made against respondents 3 and 4 with regard to selling of unclaimed dead bodies from the Osmania Hospital Mortuary for their illegal gains and utilization of an amount of Rs.85,000/- for departmental purposes without obtaining appropriate authorization, transfer proceedings i.e., G.O.Rt.No.187 (Health, Medical & Family Welfare (A1) Department) dated 31-01-2013 were issued against respondents 3 and 4 transferring them from Hyderabad to Guntur and Nizamabad respectively, but so far they have not been relieved.

Learned Government Pleader for Medical and Health filed a detailed counter stating as follows:-

“It is respectfully submitted that the Principal, OMC, Hyderabad vide Letter Rc.No.EIP/OMC/2013/3649/749, dt.08.05.2013 has informed that Dr.P.Hari Krishna, Professor of Forensic Medicine, OMC/OGH, Hyderabad has been relieved in the afternoon of 11.03.2013 in the letter No.E1/OMC/2013, Dt.11.03.2013 with a direction to report to the Principal, Guntur Medical College, Guntur.

It is respectfully submitted that further the Principal, OMC, Hyderabad, has informed that the transfer orders in respect of Dr.R.Sudha, Assistant Professor of Forensic Medicine, Osmania Medical College, Hyderabad has been forwarded to the Superintendent Osmania General Hospital, Hyderabad for implementation of the said G.O. through OMC letter No.1254/E1A/OMC/2012/417, Dt.05.03.2013 as the individual was already transferred as CAS and posted to Osmania General Hospital, Hyderabad w.e.f. 30.07.2012 forenoon. It is respectfully submitted that as per the letter No.0654/E1/2013 dt.18.03.2013 Dr.P.Hari Krishna who has been relieved on 11.03.2013 from Osmania Medical College, Hyderabad and has reported on the forenoon of 16.03.2013 at GMC, Guntur. As per the proceedings No.53792/EIB/2012-4, dt.19.3.2013 of this office. Dr.R.Sudha, has recently been promoted as Associate Professor of Forensic Medicine and posted to OMC/OGH, Hyderabad during counselling held on 19.03.2013.”

In view of the above, no further orders are required to be passed in this Public Interest Litigation.

Accordingly, the Public Interest Litigation is closed.

The miscellaneous petitions, if any, pending in this Public Interest Litigation shall stand closed.
