This is a petition for anticipatory bail filed in case bearing FIR No. 37 dated 15.3.2011, under Sections 452/447/511/427/148/ 149 IPC registered at Police Station Sadar Ludhiana.

On 08.04.2011 the following order was passed:-

“According to learned counsel for the petitioner, allegations against the petitioner, in brief are that on March 12^th , 2011 he entered into the house of father of the complainant and damaged the boundary wall an gate of the house.

Learned counsel for the petitioner has further urged that present FIR has been got registered against the petitioner to pressurise him to withdraw the complaint filed by the petitioner against the complainant party under Sections 326 and 452 etc. IPC in the Court of Area Magistrate, Ludhiana.

Notice of motion for 12.05.2011.

Meanwhile, in the event of arrest, petitioner (Jaswant Singh) be admitted to bail by Arresting Officer on his furnishing bail bonds to his satisfaction. Petitioner shall abide by the conditions laid down in Section 438(2)(i)(ii) and (iii) Cr.P.C.

A copy of this order be given dasti (by-hand) to learned counsel for the petitioner under the signatures of Court Secretary.”

stated that the petitioner has joined the investigation. Leaned counsel for the complainant has, however, argued that they have damaged the property of the complainant.

In my considered opinion it would be in the interest of justice if the order dated 08.04.2011 is made absolute subject to the conditions envisaged in Section 438(2) Cr.P.C., up to the filing of the challan, whereafter the petitioner would be required to seek regular bail.

Petition stands disposed of.
