This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case F.I.R. No.32 dated 23.03.2010 registered under Sections 307, 148, 149 IPC and under Sections 25, 27, 54 and 59 of the Arms Act at Police Station Mallanwala now at Sadar, Ferozepur.
Learned counsel for the petitioner has argued that the petitioner was only driving the Tractor and no injury was attributed to him. It is further argued that it is a case of cross version and that Section 326 is invoked against the other side but none has been arrested. It is further argued that the petitioner has now been in custody for the last 7 months.
On instructions from ASI Rashpal Singh learned Deputy Advocate General has accepted these factual assertions.
In the circumstances, I deem it appropriate to grant regular bail to the petitioner to the satisfaction of the C.J.M./Duty Magistrate, Ferozepur.
Ordered accordingly.
