Rajender Kumar & Ors. Vs State of Haryana & Ors.

The petitioners have approached this Court under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to allot them site/plots under the oustees' quota in lieu of their land acquired by the respondents.

Learned counsel for the petitioners states that the petitioners have made a representation dated 2.2.2010 (Annexure P-4) for the relief as claimed in the writ petition on which, no decision has been taken so far. Learned counsel further states that at this stage, the petitioners shall feel satisfied in case a time-bound direction is issued to the respondents to consider and decide the representation (Annexure P-4) after affording an opportunity of hearing to them.

After hearing learned counsel for the petitioners and perusing the file, the writ petition is disposed of with a direction to respondent No.2 to consider and decide the representation (Annexure P-4), by passing a speaking order and after affording an opportunity of hearing to the petitioners, within a period of two months from the date of receipt of a certified copy of the order.
