In this writ petition filed under Articles 226/227 of the Constitution of India, the petitioner has prayed for issuance of a writ in the nature of certiorari for quashing the order dated 25.11.2009 (Annexure P-1) passed by respondent No.1 whereby a sum of Rs.71,636/- was ordered to be recovered from the amount of gratuity payable to him and also a writ of mandamus directing the respondents to release his pensionary benefits, i.e. revised pension, gratuity, commuted value of pension etc.

Learned counsel for the petitioner submits that the petitioner has sent a legal notice dated 8.2.2010 (Annexure P-5) to the respondents for the same relief as claimed in this writ petition but no action has been taken thereon so far and he shall feel satisfied if a direction is issued to them to decide the same in a given time frame.

After hearing the learned counsel for the petitioner and perusing the file, the present writ petition is disposed of with a direction to the concerned respondent to take a decision on the legal notice (Annexure P-5) sent by the petitioner within a period of two months from the date of receipt of a certified copy of this order by passing a speaking order. It is further directed that in case any amount is found due to the petitioner, the same shall be released to him within two months thereafter.
