Dalbir Singh and Ors. Vs P.R.T.C. and Anr.

In this writ petition filed under Articles 226/227 of the Constitution of India, the petitioners have prayed for issuance of a writ in the nature of mandamus directing the respondents to grant them the pensionary benefits as per their entitlement, i.e. gratuity, commuted value of pension, leave encashment and arrears of dearness allowance etc.

Learned counsel for the petitioners submits that the petitioners have sent a legal notice dated 15.2.2010 (Annexure P-4) to the respondents for the same relief as claimed in this writ petition but no action has been taken thereon so far and they shall feel satisfied if a direction is issued to them to decide the same in a given time frame.

After hearing the learned counsel for the petitioners and perusing the file, the present writ petition is disposed of with a direction to the concerned respondent to take a decision on the legal notice (Annexure P-4) sent by the petitioners within a period of two months from the date of receipt of a certified copy of this order by passing a speaking order. It is further directed that in case any amount is found due to the petitioner, the same shall be released to him within two months thereafter.
