The accusation is that the co-accused, Ganesh Chauhan, started to outrage the modesty of Budhi Kumari, the minor daughter of the informant, Fula Devi. At that time, Budhi Kumari raised alarm to rescue but the petitioner did not help her rather the petitioner instigated the co-accused, Ganesh Chauhan, to outrage the modesty of Budhi Kumari.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that no specific overt act has been attributed to the petitioner rather it has only been stated that the petitioner instigated the co-accused, Ganesh

Chauhan, to outrage the modesty of Budhi Kumari at the time of alleged occurrence. The petitioner having no criminal antecedent is in custody since 12.12.2013.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Barh, Patna, in connection with Barh P.S. Case No.254 of 2013 (GR No.1413 of 2013).
