JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 2 15-04-2014 Heard learned counsel for the petitioner and the learned A.P.P. for the State. The petitioner is accused in connection with Gopalpur P.S. Case No. 15 of 2013 arising out of S. Tr. No. 1223 of 2013 registered under Section 302/34 of the Indian Penal Code.
The allegation of informant, Ramesh Ravidas, is that Munni Devi, wife of Upendra Das, came at his house and started to abuse. Thereafter, his son, Rajesh Ravidas made protest and shot fire in which Babi, daughter of Upendra Das, sustained firearm injury. Thereafter, Upendra Das, Jogi Das, Nagendra Das and this petitioner caused injury through bricks, lathi and rod to Rajesh Ravidas, while he was rushed to the hospital but he died.
Learned counsel for the petitioner submits that, in fact, deceased, Rajesh Ravidas, son of informant, shot fire at Babi,

daughter of Upendra Das and the villagers also caught hold the deceased, Rajesh Ravidas and assaulted through bricks, lathi and rod. It is also submitted that similarly situated co-accused, Upendra Ravidas, Jogi Das and Nagendra Das have already been granted privilege of bail by this Court vide order dated 01.10.2013 and 10.01.2014 passed in Criminal Misc. No. 35510 of 2013 and Criminal Misc. No. 51333 of 2013 respectively. It is further submitted that petitioner has no criminal antecedent and he is in custody since 15.07.2013.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Adhoc Additional District Judge, VI, Patna in connection with Gopalpur P.S. Case No. 15 of 2013 arising out of Sessions Trial No. 1223 of 2013.
