Petitioner is accused in connection with Natwar P.S. Case No. 51 of 2013 registered under Sections 272/273/379 of the I.P.C. and section 47(A)/55 of the Excise Act.
In course of checking of the vehicle, 10 jerking each containing 40 liters of spirit were recovered from two persons, who were in vehicle, disclosing the name of Mantu Azad and they failed to produce any documents saying that the said jerking was being carried for this petitioner.
Learned counsel appearing on behalf of the petitioner submits that petitioner has not been arrested on the spot, rather name of the petitioner has come in the confessional statement of co-accused. It is also submitted that petitioner has no criminal antecedent and is in custody since 23.01.2014.
