The petitioner seeks bail in connection with Agamkuan P.S. Case No.242 of 2013 registered under Sections 25(1-B)A, 26 and 35 of the Arms Act.
The accusation is that on the basis of the confessional statement of Randeer Kumar Singh alias Nato Singh, the police party reached at the place of occurrence and saw three persons including the petitioner sitting, who on seeing the police party started to flee away but they were apprehended, and on search, the petitioner was found in possession of one pistol with magazine, seven cartridges and mobile set. Others were also found in possession of firearms and mobile sets. The petitioner and others also confessed about their involvement in committing the murder of Shailesh Builder.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that on being arrested, on the basis of the confessional statement of the petitioner, the petitioner has been made accused in Agamkuan P.S. Case No.209 of 2013 under Sections 302 and 120-B/34 of the Indian Penal Code and except that, the petitioner has no criminal antecedent and the petitioner is in custody since 13.7.2013.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri D.K. Mishra, Judicial Magistrate, Patna City, District-Patna, in connection with Agamkuan P.S. Case No.242 of 2013. Out of the two sureties, one must be either parents or close relative of the petitioner.
