4 10-04-2014 Heard learned counsel for the petitioners and learned A.P.P. for the State. Both Criminal Applications are related to Bettiah Town P.S. Case No. 735 of 2012 registered under Sections 302/201/34, 376 of the I.P.C. and 3(i),(xi)(xii)2(v) of the S.C./S,T. Act. Therefore, both Criminal Applications have been heard together and are being disposed of by common order.

On recovery of dead body of a lady, F.I.R. was lodged against unknown by the Officer-in-charge, P.S. Bettiah Town. Later on, on the basis of photograph of the dead body, as

published in the news paper, Chanda Devi identified the dead body as of her gotni, Sita Devi (deceased) and thereafter, lodged the Complaint Case No. 2411C of 2012 against the petitioner, Rajesh Kumar Rao and four others saying that her gotni deceased, Sita Devi and her niece Gyanti Devi were kidnapped by them on 08.10.2012 in the night.

Learned counsel appearing on behalf of the petitioner submits that in course of investigation, on the basis of photograph of dead body, Chanda Devi identified the dead body as her gotni Sita Devi and filed the Complaint Case about kidnapping of Sita Devi and her daughter by the petitioner and three others, but Chanda Devi in her statement before the Police stated that when complaint was made about her illicit relation with the petitioner Rajesh Kumar Rao, Sit Devi and her daughter moved from the house saying to live with petitioner Rajesh Kumar Rao. Thereafter, police got recorded the confessional statement of the petitioner Rajesh Kumar Rao showing his involvement. It is also submitted that the name of petitioner, Arun Kumar Rao has come in the confessional statement of petitioner, Rajesh Kumar Rao. Except that, there is nothing against the petitioner, Arun Kumar Rao. It is also submitted that petitioners are co-villager of the deceased and are in custody since 09.01.2013 and 07.02.2013

Under the facts and circumstances of the case, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Bettiah (West Champaran) in connection with Bettiah Town P.S. Case No. 735 of 2012.
