3 13-01-2014 Heard learned counsel for the petitioner and learned
counsel for the State.
The petitioner seeks bail in a case registered for the
offence punishable under sections 498 (A), 354, 307, 324 and 304
(B) read with 34 of the I.P.C.
It is contended that petitioner is an old lady aged
about 70 years. She is in custody since 4 th May, 2013 and on
conclusion of investigation the case has been found to be false as
against some other accused persons.
On the other hand, learned counsel for the State
submits that the victim was set ablaze in her matrimonial home
and the F.I.R. has been registered on the basis of the Fardbeyan
made by the victim. He submitted that the statement of the victim
is in the nature of dying declaration and in her oral statement she
has specifically alleged that petitioner actively participated in the
