The petitioner seeks bail in a case registered for the offences punishable under sections 341, 323, 406, 420, 379, 504 and 506/34 of the Indian Penal Code.
It is contended that in view of the law laid down in the case of Murari Lal Gupta vs. Gopi Singh since reported in (2005) 13 SCC 699 no offence is made out. It is further contended that it is pure and simple case of money claim for which remedy is filing of civil suit before an appropriate forum.
Be that as it may, considering the nature of allegation and the fact that the petitioner is in custody since 7th February, 2013, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief
